What the letter of demand fee includes

  • Reviewing your contract, invoices and messages.
  • A name search to confirm the debtor’s correct legal identity.
  • The letter itself, emailed and posted no later than two business days after we have everything.
  • One follow-up with the debtor.
  • Passing on their reply with our view and your options.

What the statutory demand fee includes

  • Checking that the debt qualifies: owed by a company, due and payable, at least $4,000, and no sign of a genuine dispute.
  • A current ASIC search of the company, to confirm its registered office and that it is not deregistered or under external administration.
  • The demand in the prescribed form, and the affidavit verifying the debt for you to sign.
  • Service of the demand at the company’s registered office.

What is not included

  • Negotiating after the first reply, or preparing a payment plan or settlement deed.
  • Court fees, process server fees and similar outlays to third parties. We show these separately and tell you before they are incurred.

Good to know

Can I get the fee back from the debtor?

Only where your contract or trading terms make the debtor liable for collection costs. Otherwise you bear it. If the matter goes to court and you succeed, the court will decide which of your costs the debtor must pay.

Costs in writing

Before any work starts, we tell you in writing what it will cost, as the law requires. There is no charge for a quote.
